AVALIAÇÃO DO PERFIL DO TRABALHADOR PORTADOR DE LESÃO DE OMBRO SUBMETIDO À PERÍCIA MÉDICA JUDICIAL E AS AÇÕES DESENVOLVIDAS PELAS EMPRESAS RELA

Resumo
O presente trabalho tem por objetivo apresentar o perfil de portadores de patologia de ombros, que moveram processo judicial trabalhista e analisar a relação entre a saúde destes e as ações das empresas junto ao profissional lesionado. Trata-se de uma pesquisa documental, retrospectiva, descritiva, aplicada com delineamento transversal e base de análise quantitativa. Foram avaliados os autos dos processos trabalhistas registrados na justiça do trabalho que foram submetidos à perícia médica entre os anos de 2012 a 2015, com descritivo de lesão de ombro, junto ao Tribunal Regional do Trabalho na 15ª região (Campinas – São Paulo). Foram excluídos aqueles processos que estão sob sigilo da justiça. Os dados coletados foram idade, gênero, início dos sintomas, tempo de serviço, ocupação atual, tipo de lesão do ombro, queixas referidas, tipo de acrômio, doenças associadas, ações da empresa como de abertura de CAT (comunicação de acidente do trabalho), cumprimento da NR 7 por parte da organização (Programa de Prevenção de Risco Ambiental – PPRA e Programa de Coordenação Médica em Saúde Ocupacional - PCMSO). Dos 93 trabalhadores, houve predomínio de homens (58,1%). A média de idade foi de 42,6 ± 9,4 anos, sendo 54,8% na faixa etária de 35 a 49 anos. Com relação ao tempo de atuação na empresa, 66,7% apresentaram mais de cinco anos, e 40,9% apresentaram início das queixas entre um e cinco anos na função. Houve associação entre gênero e situação da ocupação atual (p<0,005), com predomínio de mulheres na ocupação do lar (13 vs 2) e com predomínio de homens na situação de procurando emprego (24 vs 10) e reintegrado por tutela (8 vs 2). Com relação às queixas, houve equilíbrio entre dor e limitação funcional. No entanto, quando comparados à ocupação atual houve diferença entre dor e limitação funcional (p<0,01). Houve associação positiva do PPRA à queixa de limitação funcional e associação negativa com a dor (p<0,04). Houve associação entre o sedentarismo e a presença de PCMSO e PPRA (p<0,04), e a ausência de emissão de CAT nas empresas (p<0,001). Conclui-se que o aparecimento ou agravo de patologias osteoarticulares de ombros, de trabalhadores que moveram processo judicial trabalhista, parecem estar associadas a hábitos individuais ou práticas laborais inadequadas. Estas podem ser evitadas com implantação de políticas locais de promoção de saúde.

Abstract
The present study has the objective to present the profile of workers with shoulder disorders related to labor law suits. It was analyzed the relationship between the worker`s health and the actions performed by the companies in relation to the injured professional. It is a retrospective, descriptive and applied research with a cross-sectional design and quantitative database analysis. The documents of the labor lawsuits with the description of shoulder injury registered at the Regional Labor Court in the 15th region (Campinas - São Paulo) labor courts were submitted to the medical examination and evaluated during the period from 2012 until 2015. The processes that were under the secrecy of justice were excluded from the study. The data collected were age, gender, onset of symptoms, length of service, current occupation, type of shoulder injury, referred complaints, type of acromion, associated or related diseases, company actions as CAT (workplace accident communication), compliance of NR 7 by the organization (Environmental Risk Prevention Program - PPRA and Medical Coordination Program in Occupational Health - PCMSO). From the 93 workers evaluated, there was a prevalence of men (58.1%), with a mean age of 42.6 ± 9.4 years, and 54.8% were included in the age group 35-49 years. Regarding the length of work time in the company, 66.7% have been working for more than five years, and 40.9% presented with complaints beginning between one and five years in the function. There was an association between gender and current occupational status (p <0.005), with predominance of women in household occupation (13 vs 2) and predominance of unemployed men in job search situation (24 vs 10) and reintegrated to work by judicial decision (8 vs. 2). Regarding the complaints, there was a balance between pain and functional limitation. However, when compared to the current occupation there was a difference between pain and functional limitation (p <0.01). There was a positive association of PPRA to the complaint of functional limitation and negative association with pain (p <0.04). There was an association between the sedentary lifestyle and the presence of PCMSO and PPRA (p <0.04), and the absence of CAT in the companies (p <0.001). It was concluded that the appearance or aggravation of osseous and articular shoulder pathologies in workers who have undertaken labor law suits seem to be associated with individual habits or inadequate labor practices. These data can help preventing the occurrence of these lesions by implementing local health promotion policies at work.
